What the New Policy Is
On 8/5/2026, USCIS issued Policy Alert PA-2026-05, which allows case officers to deny applications that lack required documents or fail to demonstrate eligibility without first sending a Request for Evidence (RFE) or Notice of Intent to Deny (NOID).
If an application does not demonstrate that the applicant meets the requirements or is missing mandatory documents, the officer can deny it immediately. The change applies to applications pending review or submitted on or after 8/5/2026.
What This Changes From Previous Practice
Previously, USCIS policy encouraged officers to send an RFE or NOID before denying an application. USCIS determined that the old guidance resulted in incomplete or frivolous applications and increased processing times.
The new policy eliminates guidance from 2021 that required officers to request additional documents before issuing a denial.
Who Is Affected
The change does not apply to only one visa category. It affects all USCIS applications, including employment-based visa petitions, green card applications such as Form I-485 Adjustment of Status, and petitions for visa extensions or status changes.
The policy applies to all applications pending review or submitted on or after 8/5/2026. There is no transition period or protection for applications submitted earlier. If your application was submitted before 8/5 but is still pending, it is also subject to the new standard.
How to Prepare
Although officers may still request additional documents when appropriate, applicants should not rely on the RFE process to correct deficiencies after submission. Thorough preparation and submission of a complete application with all required documents is now more critical than ever.
For pending applications, submitting a complete and accurate application from the first submission is essential.
Note on Response Timeframes
The policy also affects RFE requests that USCIS still chooses to send. Officers are no longer required to allow the full response period. The regulatory limits remain a maximum of 12 weeks for an RFE and 30 days for a NOID, but officers may now set shorter deadlines.
Additionally, USCIS has eliminated the 14-day extension for mail sent from outside the United States. There is now only a 3-day extension for mailing service, regardless of where you are located.
