What Is Changing
USCIS announced it will issue revised versions of Form I-539 (Application to Extend/Change Nonimmigrant Status) and Form I-765 (Application for Employment Authorization) on September 15, 2026, to comply with a final rule that eliminates Duration of Status for F and J visa holders.
The new rule replaces admission Duration of Status with fixed admission periods for F, J, and I visa holders, creating a formal extension process through USCIS. Because this rule takes effect on September 15, 2026, USCIS is requiring updated form versions immediately and will not provide a transition period.
Who Is Affected
This change affects nonimmigrant students, exchange visitors, and foreign media representatives filing applications for extensions or work authorization. Specifically, it includes students seeking Optional Practical Training (OPT) or Curricular Practical Training (CPT) work permits, exchange visitors applying for extensions, and media representatives requesting work authorization.
Exact Acceptance Rules
The new version 09/15/26 replaces older versions (08/28/24 for Form I-539 and 08/21/25 for Form I-765). Applications mailed or submitted online before September 15, 2026 must use the current version. Applications mailed or submitted online on or after September 15, 2026 must use the new version 09/15/26. Any form submitted with the wrong version for its mailing or submission date will be rejected.
Critical Point: No Transition Period
This is the most important detail. There is no transition period. USCIS is not providing one because, according to the agency, the revised forms are necessary to implement the final rule on fixed admission periods, which takes effect on the same date.
This means: if you file I-539 or I-765 on or after September 15 using the old version, USCIS will reject it immediately. There is no opportunity to correct or resubmit. If your extension deadline falls around this time, you must either act before September 15 or prepare to use the new version.
