What Changes from August 3?
From August 3, 2026, several important amendments to UK Immigration Rules take effect, affecting the Graduate route, applications involving children, Appendix FM, immigration sponsorship, asylum claims, the Electronic Travel Authorization scheme, and criminal offense regulations.
The key change to the Graduate route: Children born in the UK can now be granted dependent status in certain circumstances. Previously, this was not permitted. If you are a non-UK national holding a Graduate visa and have had a child born in the UK, your child can now be granted permission to remain without having to leave the country.
Requirements concerning childcare, accommodation, and family support have been clarified in cases involving children and family members. This means the Home Office will conduct closer scrutiny to assess whether you have the capacity to provide for children.
Criminal Offense Regulations Tighten
Suspended sentences may now impact decisions on ETAs and other immigration decisions. This is new. Previously, only actual custodial sentences were considered. Now, even suspended sentences can result in ETA denial or refusal of other visa types.
If you have any criminal history, including suspended sentences, you must disclose this when applying for a visa. Failure to disclose can result in permanent refusal.
Who Is Affected?
Those directly affected include:
- International graduates holding a Graduate visa with children born in the UK: Your children can now remain legally without requiring separate visas.
- ETA or other visa applicants with criminal histories: You must prepare carefully, as suspended sentences are now also considered.
- Families with children: Requirements for childcare and family support are now clearer but also more stringent.
Important Notice
If an application for entry clearance, Electronic Travel Authorization, leave to enter, or leave to remain was submitted before August 3, 2026, such applications will be decided under the Immigration Rules in force on August 2, 2026. In other words, if you submitted your application before August 3, you will be assessed under the old rules, not the new ones.
This is critical: The date you submit your application, not the date you pay the fee, determines which rules apply. If you are considering applying for a Graduate visa or ETA, carefully check your application submission date.
Potential Drawbacks
These new rules carry important cautions:
- Dependent children are not always permitted: Although children born in the UK can now be granted dependent status, other requirements must still be met, particularly regarding childcare and family support. The Home Office may still refuse if they determine you lack the financial capacity to provide support.
- Suspended sentences are now an issue: If you have any criminal history, including suspended sentences, you must disclose this and prepare for the possibility of refusal.
- Rules remain complex: Although requirements have been "clarified," they remain somewhat ambiguous. Each case will be assessed individually, and there are no guarantees.
