Nationality law was amended to require those with an entitlement to another nationality to formally renounce it in order to retain Zimbabwean citizenship. The problem lay in entitlement to: hundreds of thousands of descendants of workers from Malawi, Zambia and Mozambique had never held those passports, had never set foot there, and had no way to renounce a nationality they had never held.
Because on paper the law stripped nobody of citizenship — it merely required a procedure. But that procedure was impossible for precisely the people required to complete it, and failing meant losing nationality. It is the most sophisticated of the sixteen mechanisms in this library, because it never looks like an act of exclusion.
It provides that a person born in Zimbabwe with at least one parent who is a citizen of a Southern African Development Community country and ordinarily resident in Zimbabwe is a citizen by birth. That covers exactly the excluded group. The constitution also affirms that citizens by birth cannot be deprived of citizenship.
Not evenly. Many still must prove their place of birth with documents they do not have — the same circular problem seen in Kenya and Nepal. A right in a constitution and an identity card in hand are two different things, though courts have issued rulings applying the provision.
Iraq corrected by statute in 2006, Kenya by policy through the Shirika Plan, Tanzania by a completed naturalisation programme. All three can be undone by a later government. Zimbabwe placed the remedy in the constitution, the strongest protection a state can give a right.
Many people seek a second nationality as a hedge and think only about political risk. Zimbabwe shows a more concrete risk: a lifetime's savings can lose their value without anything being confiscated, anyone arrested or any decree issued. For most real people the greatest value of second residence or citizenship is the ability to open an account and hold assets in a different monetary system.
The position has shifted under the 2013 constitution and subsequent court rulings, and the applicable rules differ depending on whether a person is a citizen by birth, by descent or by naturalisation. Check the current rules and preferably take local legal advice.
